Taskular Privacy Policy

We are Taskular Pty Ltd (ABN 98 602 456 762) (us, we, our).  We provide our subscribers (Subscribers) and their customers (Customers) with access to our Taskular Platform (Service), which they can use to stay in touch and manage their interactions.

In order to do this, we collect and hold personal information which is provided to us by Subscribers and Customers when using the Service.

This Privacy Policy explains how we collect and handle personal information, and how to contact us if you have any questions about how we handle your personal information.

We take our privacy obligations seriously and are committed to handling personal information in accordance with all relevant laws including the Australian Privacy Act 1988 (Privacy Act) and applicable State and Territory health records laws (Privacy Laws).

Personal Information

In this Privacy Policy, “personal information” and “sensitive information” have the meanings given in the Privacy Act.  Essentially, personal information is any information about an identified individual or an individual who is reasonably identifiable, whether the information is true or not and whether the information is recorded in a material form or not.

Sensitive information is personal information of a sensitive nature and includes information about your health, genetics, racial or ethnic origin, religious beliefs or affiliations, membership of a professional or trade association, membership of a trade union, sexual orientation or practices and criminal record.

Any references in this Privacy Policy to “personal information” are references to both “personal information” and “sensitive information”.

Consent

By using the Service or otherwise providing us directly, or through others, with personal information, you confirm that you, and any other individual whose information you provide, have consented to us collecting, using and disclosing yours and their personal information in accordance with this Privacy Policy.

How we collect personal information

We collect personal information that is entered into the Service by our Subscribers and their Customers.  We may do this in a number of ways, including:

  • directly from you, or your kin, when you or they use the Service;
  • from the relevant Subscriber, such as the service provider who is providing you with services;  or
  • by analysing our own records of your use of the Service.

We also may collect your personal information when legally required to do so.

We will collect, use or disclose sensitive information about you only as permitted by law, for example where we have received your consent to do so or the collection is required or authorised by law.

What personal information do we collect?

All personal information we collect is entered into the Service by our Subscribers and their Customers.  Accordingly, the type of personal information we collect will depend on the information which is inputted into the Service.

This may include your name, date of birth, address, postcode, telephone numbers, email address, government issued identifiers such as your medicare number or provider number, and information about services provided to you, or which you provide to others.

If you are using the Service as a Customer or patient of a health service, we may also collect health information about you, such as allergies, medications, test results, current conditions, previous medical history, mental health, allied health and interactions with health care providers.

If we are not able to collect the information provided to us by our Subscribers and their Customers, we will not be able to provide the Service.

Cookies

As you navigate through our website and access and use the Service, certain information can be passively collected (that is, gathered without you actively providing the information) through cookie technology which we use to ensure that we can give you the best experience.  “Cookies” are small files that are transferred to your computer’s hard drive through your web browser and enable Taskular to recognise your browser and remember certain information.

We use cookies to keep track of personal preferences and compile aggregate data about traffic and interactions on the Service so that we can offer a better experience and tools in the future.  You should be able to configure your computer so that it disables cookies or does not accept them. However, if you reject all cookies, you may not be able to use or take full advantage of the Service or any of our other products or services that require you to “sign in”.

Where we combine your personal information with non-personal information gathered via cookies, the combined data will be used in accordance with this Privacy Policy, the Privacy Act and other applicable Privacy Laws.

Why do we collect your personal information?

Generally, we collect your personal information so that we can provide you with the Service.  Some of the specific purposes for which we collect your personal information are to:

  • verify your identity;
  • facilitate the provision of the Service (or other services) to you; and
  • address or respond to any requests from you.

We may also use your personal information for purposes related to those described above which would reasonably be expected by you.

We will not use your information for purposes other than those described above unless we have your consent or as permitted by law (including for law enforcement or public health and safety reasons).

If you or your organisation provide services to us, then we may collect your personal information so that we can manage our business relationship.

Disclosure of personal information

We do not disclose or share any personal information collected via the Service for any unrelated purpose, such as disclosure to third parties for sales, marketing or other commercial purposes.

However, we may disclose personal information in certain limited circumstances such as:

  • where we are required or authorised by law; or
  • where we need to provide our service providers with access our systems or

information in order for them to provide us with professional, business, technology and corporate services.
An example may be where we need to provide an IT service provider with access to our systems to provide us with support or maintenance services, however, as all Taskular data is encrypted at rest we generally do not permit these providers to access or view personal information.  We also use reputable third parties to host our data which includes the personal information we collect – we explain more about this below.

Wherever we disclose or use third party services to store personal information, we take reasonable steps to ensure that the third party only uses or holds your personal information for the purpose we disclosed it to them and in a manner consistent with the Privacy Laws.

We may also de-identify and anonymise your personal information (so that it no longer identifies you) for the purpose of aggregating it with the de-identified and anonymised information of our other customers in order to provide such information to third parties so that those third parties can use that data for their own internal or commercial purposes.

Unless you consent, we otherwise will not disclose your personal information to third parties other than as set out above.

Storage and security

We store personal information on computer databases and/or in hard copy and will take reasonable steps (including commercially reasonable physical and electronic security measures) to protect any records that we hold which contain your personal information from loss, misuse, interference, unauthorised access, modification or disclosure.  We destroy your personal information in a secure manner when we no longer need it.

We use reputable third party IT services to assist in running our business, such as data hosting provided by Amazon Web Services (AWS).  The data centres we use are fully compliant with a range of international standards and requirements including ISO 27001. They also comply with minimum tier 3 equivalent requirements and are monitored and protected by strict security measures.

Further steps that we take include encryption of data both at rest an in transit.

All personal information collected by Taskular is generally stored in the country in which you are located.  This means that our Australian customers’ personal information will be stored in Australia and our New Zealand customer’s personal information will be stored in New Zealand.

Information about others

If you use the Service to upload personal information relating to another person, it is your responsibility to:

  • inform the individual of this Privacy Policy and provide them with a copy or method of accessing this Privacy Policy;
  • inform the individual that you are proposing to disclose their personal information to us;
  • ensure that, prior to disclosure of the individual’s personal information to us, the individual agrees to the terms of this Privacy Policy; and
  • obtain the individual’s consent to the disclosure of their personal information to us (unless the disclosure is permitted by law).

If an individual does not agree to the terms of this Privacy Policy and provide their consent to the disclosure of their personal information to us (unless the disclosure is permitted by law), you must not provide their personal information to us.

By providing us with other people’s personal information you warrant that you have complied with this Privacy Policy and all applicable Privacy Laws and you indemnify us and our related bodies corporate against any and all loss arising directly or indirectly from you disclosing such information.

Access and correction

You may request access to any of the personal information we hold about you by contacting us as specified below.  We reserve the right to charge a reasonable fee for the costs of retrieval and supply of any requested information.

We will take steps to ensure that the personal information we collect, use or disclose is accurate, complete and up to date.  To ensure your personal information is accurate, please notify us of any errors or changes to your personal information and we will take appropriate steps to update or correct such information in our possession.

We expect our procedures will deal fairly and promptly with any privacy concerns or issues. However, if you remain dissatisfied, you can also make a formal complaint with the Office of the Australian Information Commissioner (which is the regulator responsible for privacy in Australia).
